1. ”We” are Endangered-big-cats.org

2. “You” are any person accessing any part of this website and/or entering into any transaction with us by means of this website (“Transactions”).

3. You agree the following terms and conditions regulate your access to our website and are incorporated into every Transaction that takes place from 1st August 2007 and take precedence over your own terms and conditions (if you have any).

4. English law will govern each Transaction and these terms and conditions will be construed according to English law.

5. We may, at our discretion, require that any dispute arising under any Transaction be adjudicated in the English courts.

6. The copyright and all other rights that may subsist anywhere in the universe from time to time in all material or any part thereof displayed on our website (“Material”) is our property or that of our contributors and business partners.

7. You may not reproduce, exploit, adapt, broadcast, exhibit, resell, publish or otherwise use by any current or future means in any shape or form anywhere in the universe the Material or any product supplied to you by us (“Products”).

8. In particular, you may not electronically store or reproduce images taken from the website or make copies of printed materials supplied to you by us for any reason.

9. Your sole rights in relation to the Products are to privately display the Products in your home or your place of work (other than a place of work involved in the business of exploiting or promoting artwork).

10. We will do our utmost to give an accurate representation of the images for sale on our website. Many factors, including restrictions on image resolution imposed by third parties, the size of the image displayed and the characteristics of your monitor may mean the Products supplied will not be exactly the same in every respect as the images you see on your monitor (usually the Products will be better).

11. The height and width of image, paper and frame sizes quoted on the website is accurate to within a tolerance of 1 (one) centimetre.

12. Each Product is individually printed and framed in response to your orders and your credit or charge card will be charged at the time you place your order.

13. We will use all reasonable efforts to deliver Products in the United Kingdom within 5 (five) days of your placing your order and within 14 (fourteen) days outside the United Kingdom.

14. Subject to clause 16 below, if we fail to deliver any Product within 45 (forty five) days of your placing your order and that Product has not already been dispatched from our factory you shall be entitled to cancel your order by sending an email to contact@endangered-big-cats.org requesting an automatic acknowledgement that your email has been received by us stating the Order Number, the nature of the Products ordered, the date of order, your name, address, telephone number, email address and means of payment including credit or charge card type and number on receipt of which we shall refund the cost of your order to the relevant card account.

15. Our liability arising from direct, indirect or consequential losses suffered by you because of our having failed to deliver the Products is limited to the cost of the Product concerned (excluding VAT and shipping costs).

16. We shall not be liable for any failure to deliver Products arising out of circumstances beyond our control such as flood, fire, labour dispute, civil commotion, riot, war, act of God, terrorism and disruption to transport. In these circumstances you will only be entitled to cancel your order, if because of these circumstances, we fail to deliver your Product within 90 (ninety) days of you placing your order and to cancel you must comply with the procedure set out in Clause 14 above.

17. You shall not be entitled to return Products to us on the basis that they are defective unless there is significant damage to or a significant defect in the print and/or frame and we are told of the defect by you within 48 (forty eight) hours of delivery by sending an email to contact@endangered-big-cats.org requesting an automatic acknowledgement that your email has been received by us stating the date of delivery, the exact nature and extent of the defect, the relevant Order Number, the nature of the Products ordered, the date of order, your name, address, telephone number, email address and means of payment including credit or charge card type and number.

18. You shall not be entitled to return Products on the basis that you do not like the artwork reproduced as part of the Product.

19. If any part of these terms and conditions is held to be unenforceable, the remaining terms and conditions shall remain in force.

20. All data about you supplied by you to us during the registration and/or ordering process shall be held securely and used strictly in accordance with the terms of the Data Protection Act 1988.

21. We may use your email address send you our newsletter and to contact you about new Products and special offers available from us and our business partners from time to time unless you indicate that you do not wish to receive these items.

22. We will store your credit and charge card details in a secure environment and will never disclose these details to any third party.

23. Products supplied to customers within the European Union will be subject to VAT.

24. Products supplied to customers outside the European Union may be subject to the imposition of taxes, levies, duties and other charges imposed by the government of the country to which the Products are delivered and these amounts are your responsibility and are not included in the price paid by you to us for those Products.

25. You shall be responsible for checking the fixing points on each framed print and for ensuring that each frame is securely affixed to the wall.
